911MYWEB offers a specialized “72 Hours Website” service designed to provide clients with a professional web presence in an expedited timeframe. These terms and conditions outline the scope, limitations, and mutual expectations for this service.
1. Service Description
1.1 The 72 Hours Website offer includes the design and development of a basic website intended solely for establishing an online presence.
1.2 Standard deliverables include:
- Up to 5 basic pages (Home, About, Services, FAQ, Contact)
- Mobile-responsive design
- Basic SEO setup
- Integration of client-provided branding elements
1.3 The timeframe of 72 hours refers to business hours only and excludes weekends (Saturday and Sunday) and federal holidays.
2. Content Requirements
2.1 The client is responsible for providing all necessary content for the website, including but not limited to:
- Text content for all pages
- High-quality images and media
- Business information (address, contact details, hours of operation)
- Logo and branding guidelines
2.2 Client is required to provide the business logo upon placing the order for the 72 Hours Website offer. If the client requires logo and brand service creation, this will extend the project timeline and is not included in the 72 Hours Website offer.
2.3 If client fails to provide sufficient content, 911MYWEB will create placeholder content based on available client information to complete the website within the 72-hour timeframe.
2.4 Content created by 911MYWEB is provided in “acceptable conditions,” defined as content that is professional, relevant to the client’s industry, and grammatically correct. This does not guarantee alignment with personal style preferences.
2.5 Client explicitly consents that 911MYWEB may use stock photos and content powered by AI but handcrafted by 911MYWEB to create website content when client-provided materials are insufficient.
2.6 Client acknowledges that stock photos and AI-assisted content used by 911MYWEB are provided for placement purposes only and should be replaced with client’s own content when available.
3. Development Scope and Limitations
3.1 The 72 Hours Website offer explicitly DOES NOT include:
- E-commerce functionality
- Custom programming features
- Custom forms beyond basic contact forms
- Database integration
- Third-party API integrations
- Custom animations or interactive elements
- Content management system customizations beyond basic setup
- Search engine optimization beyond basic meta tags
- Copywriting beyond basic placeholders
- Multiple design concepts or extensive revisions
- Performance optimization beyond standard practices
- Security features beyond standard configurations
3.2 Any features or elements not explicitly included in Section 1.2 are considered outside the scope of this service.
3.3 Changes to project scope after agreement may result in additional charges and timeline extensions.
4. Quality Expectations
4.1 While 911MYWEB strives to deliver high-quality websites, the expedited nature of the 72 Hours Website service means:
- The website may contain minor errors or imperfections
- Design elements prioritize functionality over customization
- The website meets industry standards but may not reflect all client preferences
4.2 The delivered website will be functional and professional but may require additional refinements after the initial delivery.
5. Revision Process
5.1 The 72 Hours Website offer includes one round of minor revisions after initial delivery.
5.2 Minor revisions are defined as:
- Text corrections
- Simple image replacements
- Color adjustments
- Layout tweaks that don’t require structural changes
5.3 Major revisions, additional pages, or custom features requested after delivery will incur additional costs and extend the timeline.
5.4 Revision requests must be submitted within 5 business days of initial delivery.
5.5 Client understands that requesting changes within the 72-hour development period invalidates the 72 Hours offer, could extend the project timeline, and invalidates the cancellation policy of the offer.
6. Delivery Timeline
6.1 The 72-hour development period begins upon receipt of:
- Signed agreement
- Initial payment
- All required client materials (content, images, branding elements)
6.2 Delays in providing required materials will result in corresponding delays to the delivery timeline.
6.3 The 72-hour period is calculated based on business hours (typically Monday-Friday, 9 AM-5 PM) and excludes weekends and federal holidays.
7. Payment Terms
7.1 The 72 Hours Website offer requires:
- 50% non-refundable deposit before work begins
- Remaining 50% due either prior to the commencement of the 72-hour development period or upon website completion, whichever comes first
7.2 Additional services or revisions beyond the scope outlined in these terms will be billed separately.
8. Intellectual Property
8.1 Upon full payment, the client receives rights to use the website design and structure.
8.2 911MYWEB retains the right to:
- Display the completed website in its portfolio
- Use non-confidential aspects of the design for promotional purposes
8.3 Third-party elements (stock photos, fonts, plugins) are subject to their respective licenses.
9. Technical Support
9.1 The 72 Hours Website offer includes 30 days of basic technical support following website launch.
9.2 Support is limited to fixing errors and issues directly related to the original scope of work.
9.3 Training on website management or content updates is not included but can be purchased separately.
10. Termination
10.1 Either party may terminate the agreement with written notice.
10.2 If terminated by the client after work has begun but before completion, the initial deposit is non-refundable.
10.3 If terminated by 911MYWEB for any reason other than client breach, a prorated refund will be provided.
11. Limitation of Liability
11.1 911MYWEB’s liability is limited to the amount paid for the 72 Hours Website service.
11.2 911MYWEB is not responsible for:
- Content accuracy
- Third-party service interruptions
- Security breaches not directly caused by our work
- Business losses related to website performance
- Downtime due to hosting issues outside our control
- Problems arising from client-requested modifications
- Legal compliance issues related to client’s industry regulations
- ADA or accessibility compliance beyond basic standards
- Issues related to browser compatibility with obsolete browsers
12. Force Majeure
12.1 911MYWEB shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government action, internet disruptions, or power outages.
13. Domain and Hosting
13.1 The website will be developed under 911MYWEB’s service hosting.
13.2 Client access to hosting will be limited until final payment is performed in full.
13.3 The client is responsible for acquiring and maintaining their domain name and hosting services unless explicitly included in a separate agreement.
13.4 911MYWEB is not responsible for issues arising from third-party hosting services selected by the client.
13.5 If 911MYWEB arranges hosting on behalf of the client, the client remains responsible for all associated fees and renewal costs.
14. Communication and Response Times
14.1 Client acknowledges that prompt communication is essential to completing the website within 72 hours.
14.2 Failure to respond to queries or provide requested materials within 24 hours may result in project delays not counted against the 72-hour development period.
15. Agreement
By proceeding with the 72 Hours Website service, the client acknowledges they have read, understood, and agreed to these terms and conditions.
